Protective order prosecution

A petition for a protective order is a civil matter and a protective order may be issued to protect anyone in reasonable fear of imminent bodily injury or death from another. A protective order can temporarily or permanently entitle the petitioner to certain relief including an Order that the alleged abuser be restrained from contacting the petitioner, etc. Temporary protective orders are issued for a term of 72 hours (a temporary/preliminary protective order). Thereafter, a petitioner can return within 3 days to petition for a permanent protective order of up to 2 years. A protective order can entitle a successful petitioner to temporary spousal and/or child support, possession of the family home (to the exclusion of the subject of the Order) as well as exclusive possession of a vehicle in addition to other remedies.

Protective orders and divorce

Protective order defense

At the Law Office of William R. F. Conners, P.C., we aggressively defend clients who are the target of unfounded petitions for protective orders based on false allegations of abuse. Protective orders can prevent you from contacting your children, accessing your home or other property and can be very detrimental to your long term interests in a divorce proceeding. Moreover, although a civil matter, the issuance of a protective order may have adverse consequences on your current or future employment prospects. If a protective order has been issued or may be issued against you, you need experienced defense.
