Contributory Negligence in Personal Injury
Virginia uses a “contributory negligence” standard for determining if an injured party can recover damages for negligence in court. Generally speaking, if the defendant proves any of the Plaintiff’s own negligence contributed to the accident, the lawsuit fails. Some states use a “comparative negligence” standard, which evaluates the percentage of responsibility to each party and assesses recovery to each side based upon the allocation of fault.
