What is a “contested” divorce?
A contested divorce is one in which the parties cannot agree on all or some of the issues involved in a divorce such as the division of their debts, custody and visitation terms for any children, and any spousal and/or child support terms. In the absence of a marital settlement agreement, the parties in a contested divorce engage in litigation and the issues are presented to a court for hearing and determination.
